As part of your managerial authority, you can require employees to participate in performance appraisal interviews; this practice may even be made mandatory by your collective bargaining agreement. Therefore, you are entitled to discipline employees who refuse to participate.
However, be careful: before anything else, you must inform your employees of the implementation of these interviews as well as the methods and assessment techniques you may potentially use (self-assessment, knowledge testing, etc.).
Furthermore, be aware that the purpose of the performance appraisal interview is solely to assess the professional skills of your employees, and this assessment must be based on precise, objective, and relevant criteria. As such, judges consider the use of certain imprecise and subjective criteria related to the behavioral assessment of employees, such as evaluating their courage, ethical behavior, optimism, or common sense, to be unlawful.
Note: You cannot discipline an employee who participates in the appraisal interview but refuses to sign the report due to disagreement with its content (except, for example, in cases of insulting or abusive comments).
