Company directors (managers, chairmen, chief executive officers, deputy chief executive officers, members of the Executive Board, chairman of the Executive Board, members of the Management Board, chairman of the Management Board, members of the Supervisory Board, chairman of the Supervisory Board), as well as partners of general partnerships, general partners of limited partnerships and partners of civil partnerships, now have the option of requesting that their personal address be redacted from the Trade and Companies Register (RCS(1)). Where these directors are companies, their permanent representative may also make such a request.

This measure aims to preserve the privacy of managers and to protect them against the risks of harassment, identity theft or even physical aggression.

Personal address redacted on the Kbis(2)

A request for confidentiality may be made regarding the director’s personal address on the Kbis extract. After the registrar processes this request, the address will no longer be displayed on Kbis extracts provided to the public.

A request for confidentiality may also pertain to a deed or document previously submitted to the RCS that contains the director’s personal address. The submission should include a redacted version of the document, excluding the director’s personal address, which will be published in lieu of the original.

A request for confidentiality may be submitted upon completion of a formality that requires filing a document with the RCS. The submission should include both the complete deed (containing the director’s personal address) and a redacted copy of the deed omitting the director’s personal address. Only the redacted version will be published.

Note: Exceptions exist whereby judicial authorities, the national financial intelligence unit TRACFIN, customs officials, authorized public finance administration agents, judicial police officers, notaries, commissioners of justice, administrators, judicial representatives, and certain social security bodies retain access to information regarding the personal address of directors. This information may also be made available to the company’s legal representatives, its partners, and creditors of the directors when they can demonstrate a valid claim against them arising from the exercise of their corporate office.
