The length of the notice period for an employee’s resignation is not specified by the Labor Code, except for certain professions such as journalists, sales representatives and childminders.

You must therefore consult your collective agreement. The duration of this notice period can range from one week to 3 months, depending on the employee’s seniority and professional category (worker, employee, manager, etc.).

Custom in your locality or in profession may also dictate a notice period in the event of resignation, but this only applies in the absence of a provision in the collective agreement.

Note: If your employee’s employment contract provides for a notice period for resignation that differs from what is provided for in the collective agreement or by custom, the shortest period applies.
