According to the French Labor Code, and except in cases of serious or gross misconduct, an employee with a seniority of at least 6 months is entitled, in principle, to a notice period set at:
- one month for a seniority of less than 2 years;
- 2 months for a seniority of at least 2 years.
However, if your applicable collective bargaining agreement, the employee’s employment contract, or established local practices stipulates a more favorable notice period duration or seniority condition for the employee, then you must apply those rules instead.
Please note that the following are considered more favorable for the employee:
- a longer notice period duration;
- a shorter seniority requirement to benefit from a longer notice period (for example, a notice period of 2 months for a seniority of less than 2 years).
